RULES FOR ALLOTMENT OF MD ACCN
Policy of Accn
- Accn at MILIT is divided for its staff and student officers. Accn remaining vacant after allotment to SOs is to be considered as Temporary Accn for Staff Offrs.
- Definitions of Accn.
(a) Permt/ Status Accn. All md accn of MILIT pool incl (keeping in mind the environmental realities) accn having approximate floor space as per entitlement, would be classified as ‘Permt/ Status Accn’ for the purpose of allotment to the offrs, till such time 100% accn, as per entitled MES specifications is available in the station. This includes modified two BHK accn at Old Multi-Storey complex.
(b) Temp/ Non-Status Accn. Md accn, which is not as per the entitled specifications would be considered as ‘Temp/ Non-Status Accn’. Transit accn in Offrs’ mess will be considered as temp accn.
Waiting List for Staff Offrs of MILIT
- Waiting list for Offrs Accn for Permanent, Temporary and Change of accn will be separately maintained, up-to-date at all times, by Works & Estate Sec and will be displayed on the notice board as well as on intranet/ web page of MILIT for perusal by the officers. It will be forwardedto all offrs by email on MILIT intranet on 10th of every month by AQMG.
- Fixation of Seniority. All offrs reporting to MILIT will submit an application for allotment of md accn as per format at Appendix E alongwith relevant cerificates (as applicable) besides endorsing their name in the register kept at AQMG (Works & Estate Sec) office on their physical arrival at MILIT. This form will be completed in all respects and signed in ink by the applicant. All questions will be answered. If certain columns are not applicable, the words ‘Not applicable’ will be written clearly. No columns will be left blank. The application form is to be submitted along with all relevant certificates. The offrs will also endorse their name in the register kept at AQMG (Works & Estate Sec) on their first working day. Due to exigencies of service, if this is not feasible on the very first day, it has to be completed within seven days of reporting for the duty. The date of arrival of an officer to the station to take up a permt appointment plus ante date seniority, where admissible, will determine the position of the offr in the Waiting List, if and only if, the application as per format at Appendix E is submitted with in seven days of reporting for duty,other wise the date of receipt of application will determine the position of the offr in the Waiting List in the respective roster.In such a case, NAC will be issued only from the date of registration. Qtrs on offer would strictly be allotted based on the seniority date of their vacation as per the MES Vacation Report. Fixation of Seniority of an offr in the waiting list will be done in the first SQC meeting. Offr would be considered for almt of qtr during the next SQC meet only. However, if number of qtrs vacant are more than current waitlisted offrs, they may be included after that. Under normal circumstances the date of seniority for allotment of married accommodation would be determined as per modalities given below :-
(a) Reporting/ Effective date mentioned on the posting order issued by controlling HQ of the respective services on which the officer has to assume duty/ take up permanent appt or in case the offr reports during preparatory/ joining time, his seniority would be fixed as the physical reporting date subject to publication of commensurating casualty in DO Part-II (for Army) or equivalent document (for Navy & Air Force).
(b) In case Reporting/Effective date of posting happens to be Sunday or Holiday and application is submitted by the officer on the first working day after Reporting/ Effective date, seniority will be reckoned from the Reporting/ Effective date.
OR Date of arrival, if later than (b) above.
OR Date of receipt of application by the AQMG if later than (b) and entry made in the register after a lapse of seven days.
(c) Service seniority of an officer will decide the inter-se seniority of offrs physically reporting at MILIT on the same day. In case the seniority of officers reporting on a particular day to MILIT happens to be the same, then the officer who has been married a longer time will be considered first in seniority.
(d) The qtrs will be allotted to waitlisted offrs in seniority decided as per above considerations including ante date seniority (where admissible), in order of seniority of vacation date of qtrs on offer by MES mentioned on the vacation Report. Mutual exchange of a qtr thus allotted may be accepted by the QC BOO based on written request by the consenting offrs.
- On Promotion/ Demotion. In case an officer is promoted to a higher rank subsequent to the date of his arrival in the station, his/her date of promotion will determine the position of the offr in the Waiting List, provided the application for higher class of accn is made with in seven days from the date of promotion, otherwise the date of receipt of application will determine the position of the offr in the Waiting List in there respective roster. The officer will not be deprived of his/her seniority in the lower class of accn appropriate to the rank held prior to his/her promotion in case the permanent md accn has not been provided to him/her till the date of promotion. In case at the time of promotion, an officer is already in occupation of a md accn, he/she will not be required to surrender the same until he/she is allotted a md accn as per revised entitlement. If an officer is reverted to a lower rank, which renders him/her in eligible to occupy the md accn, which he/she is occupying, he/she will be allotted the first available md accn as per his/her revised entitlement. However, the officer will not be asked to surrender the quarter already in his/her occupation until he/she is allotted a quarter conforming to his/her revised entitlement. In such cases,HoF/ HoD will be responsible to intimate the date of demotion of the officer to the QC.In the event of an officer’s promotion or revision to a rank, which renders him ineligible to occupy the quarter, which he is occupying or which renders him ineligible to be borne on the waiting list on which he is borne, he is to be transferred to an appropriate waiting list and his position is to be determined in the manner discussed in Para 34 and 35.
- Officer not in Occupation of any Permt Md Accn. If an officer is not occupying any permt md accn allotted by the station, his position on the waiting list appropriate to his new rank is to be determined as follows:-
(a) For Status Accn. In case an officer of the rank of Capt is promoted to the rank of Maj, his position in Maj pool for status accn is to be determined from the date on which his new rank becomes effective. However, in case of a Maj/ Lt Col, who is promoted to the rank of Lt Col/ Col, his position for status accn in new pool is to be determined from the date on which his position in waiting list of pool of previous rank was determined.
(b) For Non-status accn. From the date on which his position in the waiting list was determined according to his previous rank.
- Officer in Occupation of Permt/ Non-Status Md Accn. If an officer is already in occupation of:-
(a) Status Accn applicable according to his/ her Previous Rank. The offr is to be given the benefit of his new rank only from the date on which the new rank is to become effective. That means if a Lt Col occupying a Lt Col type accn is promoted to the rank of Col/ Col (TS), his seniority for Col/ Col (TS) type accn is to be considered only from the date of his promotion to Col/ Col (TS) rank.
(b) Non-Status Accn applicable according to his/ her Previous Rank. The offr’s position on the waiting list appropriate to his new rank for status accn will be determined from the date his new rank becomes effective and for non-status accn from initial date of registration. That means if a Capt occupying a Capt type accn is promoted to the rank of Maj, his seniority for Maj type accn in new pool is to be considered only from the date of his promotion to Maj rank. He will not be required to vacate the non-status accn occupied by him. However, in the event of a Major Lt Col occupying a Capt type accn, getting promoted to the rank of Lt Col or Col, his seniority for the status accn in new pool is to be counted from the date of his original registration in previous pool.
(c) On promotion, an officer’s name will be transferred to the pool of his new rank with effect from his date of promotion only on receipt of personal application submitted by him within seven days from the date of promotion. Thereafter, date of application will be date of seniority for allotment of status/non-status accn of new rank.
- Marriage. If an officer gets married after his/her posting to the Station, the seniority for allotment of md accn will count from the date of receipt of his/her application by MILIT QC after his/her marriage.
- Grant of Ante-Date Seniority for Allotment of Md Accn. Ante-date seniority for the purpose of allotment of accn will be granted to service offrs, including those offrs, who are re-employed without any break in service, subject to rendering the certificate as per Para 13 of the application form at Appx E. Offrsarr from stns, where md accn of any kind (temp accn not to be considered) could not be provided to them under any arrangements or from field service areas, where they are precluded from taking their families or when serving overseas/afloat for not less than six months in the previous duty station, will, on posting to a peace station, have their seniority ante-dated by half of the period they spent in the previous duty station/ship of duty (maximum period of one year only), irrespective of whether they retained family accn/ separated family accn at the previous duty station. Similar ante-date will be allowed to offrs on return from their posting to Assam Rifles or other org to which Army offrs are posted on deputation without the offrs having any option. The stipulation that md accn was not provided during tenure with the org, referred to above, will apply in their cases also. (Ref Para 34 of SAO 10/S/86). Ante-date seniority certificate is to be signed by StnCdr or authorised allotting authority.
- Seniority of Officers Retaining Accn on Children Education Ground (CEG). An officer, who retains family accn at the old duty station on grounds of education of children, is entitled to apply for md accn at the new station, however, md accnwill not be offered to him till the date of retention of family accn at the old duty station. He can be offered accn after the date of retention or after the actual date of vacation, whichever is earlier. However, to avoid difficulties in shifting from old duty stn to new duty stn and to enable the offr to shift directly into a md accn, the offr, based on an application from him, could be allotted a md accn at new duty stn up to max 10 days before handing over the accn at old duty stn.As and when a md accn is offered to him, his seniority for the purpose is to be reckoned from the date of his arrival in the station or date of his application for allotment of accn, if submitted after seven days of reporting to the Stn, whichever is later. This option is not available to the officer retaining accn at previous duty station on any grounds other than children education.
- Allotment of Accn to Officer Retaining Accn on NAC. An officer, who retains family accn at old duty station for a period of two months initially or on grounds of non- availability of accn, can be allotted with an accn as per his turn without any pre-condition of vacation of accn retained by him at previous duty station. The officer, however, is required to vacate the accn at previous station within 30 days of him taking over new accn, failing which, he may be charged damage rate of license fee for the accn at previous station.
Station Seniority
- Station seniority is to be granted on the following basis:-
(a) Defenceunits/ formations located within a distance of 20 km from a city/town are treated at par with the units located within the city/town. Personnel posted from one unit to another unit within this ambit will be entitled for station seniority from the date of original posting to the first unit within the station subject to the conditions mentioned in clause (d) below.
(b) This provision is also applicable in respect of postings even beyond 20 km provided that it is within the municipal/city/town/metro limits.
(c) This provision is admissible whether they were or were not allotted accn in their previous unit located in the same station.
(d) The composite transfer grant is permissible only wherever change of residence is involved i.e. the station pool providing married accommodation to personnel in the new duty station is different from the one providing accommodation to personnel in previous duty station. Station seniority shall be granted in such cases where personnel posted in are paid the composite transfer grant restricted to one third of basic pay in terms of Govt of India, Min of Def letter No 12630/Q Mov C/3198/ D(Mov)/98 dated 28 Oct 98.
Waiting List for Student Offrs of MILIT
- Only one waiting list of accn will be maintained for SOs of a particular course. Waiting list for offrsaccn for Student Offs will be prepared in the following way: –
(a) OsIC of long courses will prepare a list of SOs desirous of occupying md accn at Girinagar campus at least eight weeks before arrival of SOs. The list should clearly bring out the fd area seniority, medical reasons or compassionate grnds, if any, and furnish it to the Wks& Estate Sec.
(b) The QC will scrutinise lists received from all OsIC Courses (DSTSC (Army), DSTSC (AF) and TTC) and subsequently formulate one waiting list for the course under consideration. QC will analyse the number of accn in permt and temporary category and allot them proportionally to SOs form all three services, based on strength of the course, giving due importance to collocation of all three service officers in one cluster of accn. As far as possible, allocation of all qtrs in one cluster to one service is to be avoided. (E.g., DSTSC (Army) and DSTSC (AF) having a strength of 90 and 30 respectively should be allotted the permtaccn in the ratio of 3:1. Allocation of qtrs in a cluster of accn having four/ six/ ten qtrs should accommodate three Army & one AF/ four Army & two AF/ eight Army and two AF SOs respectively.) After allotting of the md accn, the QC will submit its recommendations through its PO to CoA for approval of the Comdt. On approval of the QC minutes, final recommendation will be fwd to Estate Manager, EMU (R&D) for allotment of accn.
(c) This process should be completed at least four weeks prior to arrival of SOs, to allow MES to complete welcome maintenance of these houses.
(d) The OIC Course will prioritise the maint of houses based on ‘which would be occupied first’. The list of priority would be given to the GE by the Wks& Estate Sec after scrutiny.
- Efforts will be made to allot entitled accn to maximum number of studentoffrs. If this is not possible, then temporary accn will be allotted to remaining offrs. The QC is to apply exactly the same rules as used for preparing a waiting list of Staff Offrs while preparing that for SOs. Criteria such as number of children, number of family members, accompanying old parents are strictly not to be considered for preparing the waiting list. Allotment of required accn based on medical grounds could be done in exceptional circumstances on merit of each case after scrutinizing the attached, duly signed medical documents. Vacant permtaccn of Staff Offr Pool may be considered for allotment to student offrs, if available.
Out of Turn Allotment
- No out of turn allotment for any person what so ever shall be made. The houses will be allotted strictly on the basis of seniority roster except under Medical/Administrative Ground. The QC may allot accn on out of turn basis for administrative reasons and on medical grounds in exceptional circumstance son merits of each case. A medical certificate as per Appx Fwill be required for allotment of accn on medical grounds. In such cases, initially the officer may be allotted a lower class of accn and granted change after the stipulated period. Approval of Comdt, MILIT will be obtained for out of turn allotment of accn. Pregnancies, by their very nature, will not merit any such consideration, unless a complicated case is certified by the CH (SC).
Allotment of Lower/Higher Class of Accn/Bungalows/Garages
- An officer may be allotted accn of a class higher than that of his entitlement after the possibility of allotting it to an officer of the appropriate rank or making two officers share it, had been ruled out on administrative grounds.Offr be allotted accn on arr as per SQC mtg. However, no newly posted offr will be directly allotted a bungalow even if vacant. Newly posted offr will only be considered for direct allotment of bungalow if no offr (already staying in flat type qtrs) as per the seniority list of the stn opts for the Bungalow. An Offr who gives his unwillingness when allotted a bunglow should not be offered bungalow for next six months but his status quo in seniority is retained and included in the list after six months . Benefit of fd seniority is not to be given for almt of bungalow since the offr would already have availed benefit once while being initially considered for almt of qtr. An officer can be allotted lower class of accn for administrative reasons such as non-availability of proper class of accn
- There is no authority available with MES for almt of garages. Allottment of Garages will be as given below :-
(a) Qtr No 1 – Garage outside Rd.
(b) Qtr No 2 – Large Garage adjoining house.
(c) Qtr No 3 – Large Garage adjoining Qtr No 1.
(d) Qtr No 4 – Two small Garages.
Allotment of Single Quarters
- If a married officer has been allotted md accn and due to certain reasons his family leaves him for any temporary period, he may relinquish his md accn and he be allotted a single quarter, if he so wishes, provided no permt md accn remains vacant at the station.
Allotment of Accn to Officers on Study Leave
- Officers on study leave can also apply for family accn at the study leave station subject to the following conditions:-
(a) No permt accn remains vacant at the old duty station.
(b) No TA/DA will be payable for the move to the study leave station and TA/DA for the move for joining duty at new station will be restricted to TA/DA from place of residence of the family to the new station, or from old duty station, which ever is less.
- The offrs on Study Leave are entitled to regular Govt Accn or Hired Accn or Accn on HRR or HRA. However, the priority for allotment of regular Govt Accn shall be to the offrs posted on duty in the Stn. All offrs posted in the Stn would be allowed permt accn ahead of the Study Lve Offrs. Hence, when an officer proceeding on study leave applies for accn in a Stn, or applies for retention of accn, in which the officer was staying being posted to that station, the officer can avail the facility of HRA. He would vacate the regular accn within 10 days of commencement of study leave. Retention of same or alternate accn on CEG is not permitted to officers proceeding on study leave as the provision of retention of accn on CEG as per SAO 10/S/86 is applicable only for officers posted from one peace station to another peace station. The reserved accn vide para 103 of SAO 10/S/86 will in no case be allowed to be retained by the officer and shall be vacated within 10 days of commencement of the study leave. In case there is a lower status accn available in the station on the date of commencement of study leave, the officer on study leave maybe considered for allotment of lower status accn provided the officer is willing to accept the offer. Else, the officer shall be offered HRA. However, a request for retention of permt md accn by a MILIT Staff Offr proceeding on Study Live at Pune could be entertained based on the availability of permt accn at MILIT and status of Waiting List of Staff Offrs. Comdt, MILIT will be the final authority to permit retention of such accn.
Allotment to Re-employed Officers
- Re-employed Brig, Col, Lt Col, time scale Cols will be equated for the purposes of allotment of md accn as per rank held at the time of retirement.
When Husband and Wife are Govt Employees and Posted at the Same Station
- In stations, where both husband and wife are in Defence Services in the same station (not necessarily in the same Unit) of posting, only one unit of md accn will be allotted to them in accordance with seniority of either of them on the waiting list in the proper class. The station means units located within a distance of 20 km and full transfer grant is not admissible on posting from one unit to other within the station. The couple will have the option to choose as to on whose name accn is to be taken.
- In case of refusal to take over accn in respect of officers, who have been offered accn first according to his/her seniority, NAC in respect of only the officers who have refused accn will cease from the date of such refusal. However, when accn has been allotted to either of them in accordance with seniority, the NAC to the spouse will also cease for the period the officers are jointly in occupation of accn.
- Where either husband or wife is in civil employment at the same station, Government accn (Civil or Defence) will be claimed only from one of the sources.
- Both husband and wife are required to register their names with respective OIC Md Accn/ QC on arrival on posting in accordance with the rules of the respective stations. However, only one of them will be allotted with accn. The name of other officer will be retained on the waiting list and not relegated. His/her name will be considered for allotment as and when once the spouse on whose name quarter has been allotted is posted out.
- In the event of posting of one of the spouses, the spouse, who is not posted out will not be asked to vacate the quarter. In case both the officers are/were posted to the same unit or the accn is being controlled/administered by the same station, then the quarter in occupation will be transferred in the name of the spouse, who is still on the strength of the station provided he/ she fulfils the following conditions:-
- Has registered his/her name.
- Eligible for allotment of same quarter according his/her status.
- On posted strength of the unit/station, where such quarter is existing.
- In case he/she is not eligible for allotment of same quarter on his/her name, he/she will not be asked to vacate the quarter till such time he/she is allotted with alternate quarter according to his/her status.
- In case both the officers are/were posted to different units and the accn is being controlled/administered by two different stations, then on posting of the spouse, on whose name the quarter in occupation was allotted, the other spouse will not be asked to vacate the quarter till such time he/she is allotted with accn by the station/unit to which he/she is posted.
- Normally only one unit of accn will be allotted to either of the husband and wife in Defence Services in the same station (not necessarily same Unit) of posting except for the following conditions, under which both offrs shall be allotted with an accn under these rules:-
(a) Husband and wife are posted in different stations, separated by a distance of 20 km or more.
(b) Husband and wife are residing separately in pursuance of an order of judicial separation made by any court.
(c) Husband/ wife who was allotted a quarter earlier and has been surrendered it for any reason.
Allotment Order
- Allotment of md quarters is to be made as per the format of allotment order given in Appx H. A copy of allotment letter is to be addressed to CoA and BSO of new stnand BSO and C Adm O of old duty stn in case of retention. Allotted accn will be taken over by offr within max 14 days, delay if any may be reported to Col Adm.
Period of Acceptance
- The officer will be allowed a maximum of 10 days after the date of allotment, and after the MES has carried out the welcome maint ,to move into the house allotted to him. Rent will become payable even if the officer does not accept the accn at the end of this period, unless the allotment is formally cancelled by the Comdt, MILIT. Rent will be charged from the date of occupation to the date of vacation of the quarter.
Period of Occupation
- Once an eligible officer occupies a quarter, he is to be permitted to continue occupying it or another quarter during his stay at the Station, unless vacation of the quarter is ordered on disciplinary or administrative grounds by Comdt, MILIT.
Families to Reside with Officers
- An implied condition for the allotment of a quarter to an officer and its acceptance by him is that he and his family will live in it. He is, therefore, to be accompanied by his family as long as he occupies the quarter, with the following exceptions:-
(a) A specific period is to be laid down, within which, he is to bring his family after the allotment of the quarter.
(b) Specific rules are to be laid down relating to the quarter being used by an officer under the following circumstances:-
(i) The family being away from the duty station.
(ii) Medical grounds and other reasons, under which, it will become necessary to stay in a md qtr without family.
Deferment of Allotment
- An officer,without losing his position on the waiting list, may request in writing that he may not be offered accn of a particular class, indicating the exact period for which the officer wishes the allotment of accn to be deferred. The minimum period of deferment will be 3 months and any extension there of will also be for a definite period, which will not be less than one month at a time. This provision should be given on extreme grounds of exceptional cases only. It is the responsibility of the MILIT administration to ensure that deferment of allotment of md accn is not misused in any way.
- An officer proceeding on annual/sick/furlough leave for atleast a period of one month, may request in writing before proceeding on such leave that no accn may be offered to him during the period of leave.
- The provision of rules of deferment will be subject to the stipulation that Government permanent md accn does not remain vacant in the station. Should the officer, who has sought deferment of allotment of accn, become entitled to accn in his own turn, his NA Certificate will cease wef the date he becomes due for allotment of accn and intimation to this effect will be forwarded to the concerned UABSO.
Commercial Use
- Commercial use will only be for socially useful home based activity, to improve the quality of life.Guidelines for permitting use of government residential accn by working members of the families of Armed Forces personnel/civilians paid from Defence Services Estimates are given in Appx G.
Relegation on the Waiting List
- Offrs who do not accept the allotment of entitled accn will be brought down at the bottom of waiting list for a period of six months for not accepting permanent accn. These offrs will not be entitled to HRA during these six months. Relegation on the waiting list will not entail any loss in seniority but the officer will not be offered that type of accn again during the period of relegation. Absence of the officer from the station on short leave/duty will not be accepted as a plea against relegation of seniority in the waiting list for that type of accn. Officers while leaving the Station should make arrangements to take over the accn offered in their absence unless deferment of allotment has been asked for in accordance with Paras 61, 62 and 63 above.
Acceptance, Refusal and Occupation of Quarters
- Acceptance, refusal and occupation rules of Govt Md Accn are as follows: –
(a) On being allotted a quarter, an officer is to occupy it within 10 days. If an allottee is not in a position to occupy it within the stipulated period, he is to inform the Administration in writing at least five days prior to the expiry of 10 days period so that the Administration may take action for the allotment of the quarter to another officer. His position on the waiting list for the allotment of another quarter on a later date will be determined by the QC according to the merits of the case.
(b) An officer occupying lower status or temporary accn when allotted with higher status or permtaccn is to take over higher status accn and vacate lower status or temporary accnwithin 10 days of allotment. This period may be extended by the QC on written request from the officer. In such case, officer will be charged normal license fee for both accn. However, in case the officer fails to vacate the earlier occupied accn within 10 days or extended time allowed by the QC, the officer is to be charged damage rate of license fee for the older accn for the period beyond 10 days/ extended period.
(c) Should an officer, without permission, fail to occupy the quarter allotted to him within the stipulated period, the allotment is to be cancelled and his name is to be brought down in the list, by a period specifically laid down in Para 65 above.
(d) In the event of an officer declining to accept or to occupy a quarter allotted to him, the officer will not be offered any house for a period of six months from the date of his refusal, even if the officer’s name comes up again after relegation as per provisions of Para 67 below. The house will then be offered to the next officer on the waiting list.
Procedure of Relegation on Refusal/Failure to take over
- The name of the officer, who fails to take over/declines to accept the quarter allotted to him by the stipulated date or proceeds on leave/ T/Duty/posting without informing the QC and without authorising any officer to take over the accn on his behalf, will be brought down on the waiting roster, on the date of refusal or on the last date given for occupation, whichever is earlier, in the following manner :-
(a) First Refusal for Non StatusAccn. Name of the officer refusing to accept/failing to take over the non-status quarter for the first time will be brought down by a period of three months in the waiting list for non-status, but his seniority for status accn will not be affected.
(b) Second Refusal for Non StatusAccn. On second refusal/failing to take over, name of the officer will be brought down further by a period of three months, not affecting his seniority for status accn.
(c) Third Refusal for Non StatusAccn. On third refusal, name of the officer will be deleted from the waiting list for non-status accn, not affecting his seniority for status accn. He may be allowed to re-register his name after six months from the date of deletion of his name.
(d) Refusal of Status Accn by an Officer Occupying a Mess Accn/ Temp Accn. If an officer, occupying a non-status accn, refuses a status accn on allotment, his/her name will be lowered on the waiting list of Status Accn as per the procedure mentioned below :-
(i) First Refusal for Status Accn. Name of the officer refusing to accept the status quarter for the first time will be brought down by a period of six months.
(ii) Second Refusal for Status Accn. On second refusal, name of the officer will be brought down further by a period of six months.
(iii) Third Refusal for Status Accn. On third refusal, name of the officer will be deleted from the waiting list for status accn.
Mutual Exchange
- Mutual exchange of quarters is not permitted by officers except with prior permission of the Comdt, MILIT, provided the accn is of the same type of class and neither of the occupant is under transfer. This facility could be availed only on extreme circumstances and only once during the tenure of offrs.
Change of Accn
- An officer may seek only one change of accn in the same class on completion of six month stay in the accn occupied, for special reasons to be mentioned in the application. Seniority for change will be reckoned as under:-
(a) From the date, from which an officer becomes entitled to allotment of accn, if he applies for change within one month after completing six month stay in the accn occupied by him.
(b) If application for change is made after the prescribed period as indicated in Sub-para (a) above, the period, by which the officer’s application is late, will be deducted from his original seniority for determining seniority for change of accn.
(c) After the seniority for change of accn has been determined in accordance with(a) or (b) above, change of accn will be allowed from acommon roster along with fresh allotments.
- Reasons for change of accn could be ‘shfting to a better accn (bungalow/ any other qtr entitled to the offr)’ or any other special reason.
Administrative Grounds
- If the Comdt, MILIT desires that the occupant officer to change from one quarter to another for administrative reasons or when in occupation of an out of class accn (higher or lower) or when the house occupied has been approved for repairs, demolition and soon, the officer should move without any representation to the alternative accn offered to him. Non-compliance will render the officer liable to payment of damage rate of licence fee as applicable to un-authorised occupants, besides disciplinary action.
Utilisation of Surplus Accn
- Government built accn lying surplus to the rquirement of service officers may be allotted on a temporary basis to defence officers serving with DGI/R&D as also to defence civilians on a temporary basis with the stipulation that they will vacate the accn at short notice as and when such accn is required for entitled service personnel in the station.
Allotment of Md Accn to Single Officers on Administrative Grounds
- A single officer may be allotted a md quarter for administrative reasons. The term ‘Administrative Reason’ for this purpose means the allotment of an entire md accn to a single officer because he is required by the nature of the appointment held by him to occupy a md quarter normally allotted to the incumbent of the appointment. A single officer when allotted md accn on administrative grounds will pay licence fee at the existing rate in accordance with Government of India, Ministry of Defence letter No.1(1)/87/D(Q&C) dated 13 Jan 88. (Refer Para 11 above).
Occupation and Vacation of Quarters and Messes
- All officers occupying government accn will be personally responsible to ensure that vacant possession there of is made over to the authorities concerned by due date when they cease to be entitled to retain this accn. The accn will include all ancillary accn and other buildings/structures/ garrage/ servant qtr handedover to the officer at the time of taking over the accn,failure to do so constitutes an offence punishable under the Army/ Navy/ AF Act.
- 48. Once a md quarter has been allotted to an officer and he has taken over the same, he will not normally be required to vacate the quarter while on the strength of the station; unless circumstances arise which make the continued occupation of the quarter by the individual, his family or household inappropriate or impossible, or except under any of the following circumstances:-
(a) When the person to whom the quarter is allotted is posted out from the station.
(b) When the person proceeds on temporary duty elsewhere for a period, which is expected to exceed six months.
(c) When the person to whom the quarter is allotted is absent without leave for more than 30 days and there is no satisfactory explanation for his absence.
(d) In addition, misconduct, misbehavior or a breach of regulations in vogue at this station on the part of the person to whom the quarter is allotted or any member of his family or any other person living in or using the quarter, may lead to all its occupants being required to vacate it.
Conditions of Occupation of Officer’s Md Quarter
- It is important that Govt owned buildings are to be treated with care in order to minimize damages. All officers are to ensure the following while taking over, in occupation and handing over of the quarter:-
(a) On Taking Over. At the time of taking over of the allotted accn, the officer has to take following actions:-
(i) Check all furniture items, electrical fittings/fixtures, sanitary fittings, doors and windows, kitchen shelves, and full inventory.
(ii) Check serviceability of electric meters and note the meter readings.
(b) During Occupation. While in occupation of the quarter, the officers are expected to ensure following:-
(i) House should be kept neat and clean at all times.
(ii) Cleaning of compound and surroundings up to 10 mtrs and maintenance of garden is the responsibility of the occupant.
(iii) Windows and ventilators of the house must be regularly opened and cleaned.
(iv) Fly proof jalli wherever fixed must be dusted and cleaned regularly.
(v) Bathroom and kitchen tiles, marble flooring /shelves must be cleaned with bleaching powder at regular intervals.
(vi) Sanitary fittings must be regularly cleaned.
(vii) Roof of the house must be kept clean, free from foliage and vegetation. No tree should be allowed to grow on roof walls, drains and chajjas especially near water tanks/pipes.
(viii) Furniture items not required/surplus may be returned to BSO. Under no circumstances furniture should be left in the open to the vagaries of nature.
(ix) Tables/stools should not be used to support coolers/ air conditioners. Rain and sun cause irreparable loss to wood and sunmica.
(x) Garden chairs/tables must be put under shade to protect from sun and rain.
(xi) Fans, lampshades, regulators, switchboards should be regularly cleaned.
(xii) Nails should not be fixed unmindfully. If required, nails may be drilled with punch or drill machines using fillets only.
(xiii) Servant quarters attached to the accn are allotted to the offrs. It will be the responsibility of the offr to obtain security pass for the servant. Only the family of the servant, i.e., husband, wife and children (male child above 18 years not permitted), are allowed to stay. A max of five members of one family can stay. However, no guests will be permitted to stay in servant quarters. No commercial activity of any kind will be allowed in the government accn/ premises.
(c) On Handing Over. At the time of handing over the quarter, the officers should ensure that:-
(i) Complete house including compound are cleaned and swept.
(ii) Toilets including sanitary fittings are cleaned.
(iii) All almirahs, cupboards and shelves are emptied removing all papers.
(iv) Walls and ceiling are cleaned.
- Ventilators and windows are closed.
- Furniture are stacked neatly.
- Curtains and hangar rods are repositioned at the respective places.
- All wastes are burnt and dustbins emptied.
- All taps are closed.
- Servant quarter is vacated before handing over of quarter. Offrs not giving vacant possession will be liable to pay damage rate of rent for not vacating the complete accn. Servant quarters will be handed over to MES in vacant state by the Offr, on being posted out.
- The following are also to be adhered to by all the occupants of Officers’ Md Quarters:-
(a) An occupant at all times is to allow to his residence or quarter to such officer, airmen, MES employee and others who may be required to enter it, in the performance of their duties.
(b) An occupant is to report to the medical officer any case of notable disease which occurs in his household.
(c) The occupant of a md quarter is responsible for maintaining it in a clean and hygienic condition, for reporting promptly any defect or damage and for taking all reasonable precautions to safeguard public property.
(d) Occupants are not permitted to make any alteration to the buildings without authority.
